I represented the seller in a residential real estate matter involving a title defect which required me to hold funds in escrow after closing pending clearing of title. The escrow funds were subsequently released by me to the seller in good faith. Nonetheless, the title defect had never been cleare...d and several years later it again surfaced in connection with a subsequent planned sale of the property. The result was a lawsuit against me and my former client, as well as an ethics claim being filed against me for malpractice and misappropriation of the escrow funds.
