Description: Following an automobile accident injuring three persons, the insurer of the automobile brought an interpleader action and deposited with the court the amount of its maximum underinsured motorist coverage liability. The amount deposited was insufficient to fully compensate the injured persons for their damages. The Superior Court distributed the insurance proceeds on a pro rata basis without regard to a "per person" limitation in the policy. The Supreme Court reversed the trial court ruling holding that the "per person" limitation applied.
