Description: This was a Miller Act Action in U.S. District Court for the Western District of Washington at Tacoma. Con Force Manufactured Prestressed Concrete Pilings for an Aircraft Carrier Pier at a Navy Base. The Pilings Cracked when driven. The General Contractor claimed that Con Force was responsible and brought claims of over $ 7 Million against it. Bruce Babbitt Represented Con Force and brought claims for payment of the cost of the pilings, claiming that the General Contractor's design was inadequate. Following extensive motion practice, including dispositive motions, the case settled in Con Force's favor, yielding a seven figure recovery.
