Case Conclusion Date: October 30, 2009

Practice Area: Bankruptcy / Chapter 7

Outcome: It took almost 5 months (and a threat to file suit against the employer for violating bankruptcy laws), but we were able to get back the legally-due amount of garnished wages.

Description: Client had worked for profitable, very large local technology business in a high-income job, but lost job during the on-going recession. Attempts to find a job paying even 1/2 of what Client earned was impossible and Client ended up with a relatively low-paying job. Client had automobile repossessed and was sued for the balance of the automobile loan left over after the sale. As a result, Client had wages garnished. After filing Chapter 7 for this Client, we set about to find out who had his garnished monies (i.e., court, employer, lawyers, creditor). Each place we contacted said it was one of the others who had the money. Eventually, it was determined that the employer had the garnished monies. Each division of the employer kept referring us to another division within the company, including the human resources department referring us to the human resources department.
