If I could give him a 0 I would. After telling me that my case was pretty cut and dry (only assets were two vehicles and a home in my ex's name) and one child, he said it would be quick and to the point. He took a $5000 retainer and said it wouldn't go over that. Fast forward to the longest drawn out case I've ever heard of and add $12,000 to that original quote and that's where I'm at. I can't understand it, as a previous reviewer said you're charged for every time he opens the file to either correct a misspelled word or refresh his memory. When I'd call to tell him that my ex was not paying the mortgage, not paying alimony, and not paying child support he'd be away from his desk and not call back. When we went to court because my ex let the house go back to the bank and refused to sign it over to me, he moved to have all of my alimony erased as well. I was constantly wondering if he was on my side or my ex's side. So the home was lost, the one vehicle was almost repossessed, my $12,000 in alimony was forgiven and I was given a bill of $17,xxx. Unbelievable. Worst attorney ever.
Iwas treated very professionally and with great passion by Ron as he handled a child custody case fpr mw a few years ago. Ron died in October 21st of this year and he will be missed.
After changing attorneys from one who "lost my file" I thought Mr. Hergert would fight for me. After the court date he continued to make letter revisions to a simple letter stating all the areas where my ex had not done anything. The letter was revised over three times and sent 9 months later with no follow up. Still nothing was done by my ex-Hergert charged me over $12,000 by billing $32.50 to just open the file (because he forgot something) calls were not returned and each month I could count on receiving another statement on work that was not written specifically on statement but left as "Prep of Memorandum to File". I believe ANY attorney would have followed through more and accomplished more in less time. He is a gentleman and very kind, but is that what you need in an attorney? I now have no money left and since he didnt go after my ex to pay $3,700.00 as court paper says he is going after ME for it! He allowed my ex to empty an IRA telling me he would not be able to instead of demanding he sign transfer of ownership papers. How fair is that?!
I was referred to Ronald Hergert by an acquaintance and assumed I would be in good hands when I contacted him to have him put together a very basic prenuptial agreement for myself and fiancée. I assumed this would be a very quick and easy process being that I had limited assets and my fiancée was in the same boat along with neither of us having children. The costs of his services were near twice as expensive as what I was quoted by other attorney's (after calling post assistance) and his response time was simply nonexistent. I had multiple call in times (via the phone) where Mr. Hergert simply did not call in or I was told last minute that he had court to attend (all the sudden). It took over TWO months for Mr Hergert to put together a prenuptial agreement that had spelling errors and more concerning left me with a document "open to discussion" that may end up jeopardizing my assets down the road.
I have worked with attorney's in the past in business related matters so I do have an understanding of how legal processes work and my experience with Mr Hergert was not a pleasant one. Shop around as there are many to choose from that are competent and reasonable.
While Mr Hergert knows the law and has been practicing for many years his primary goal is to reach quick settlement. He did not fight for my assets in child custody/divorce case when my "ex" had no bargaining power. He stuck with a set Matrix formula, while this isn't "wrong" or illegal, he didn't fight for me. He said he would protect the division of my property being the house and a car for the ex. When I confronted him on protecting me if I'm still on title yet giving her the assets and she will "owe" me..... Itrusted that I would be protected. Within a year she remarries, lets the house foreclose and didn't make payments on the car. Who do you think they went after? the person on title. Mr. Hergerts response was to take her back to court to get more judgements that will never be collectible. When my ex remarried I wanted to file a motion to change the alimony. Mr Hergert suggested I keep making alomony payments until the hearing. I refused. She owed me so much money in judgements, just damaged my credit and I refuesed. Mr. Hergert said the judge would find me in contempt. I fired Mr. Hergert and didn't pay the back alimony of $6800 and the judge said this would be "offset" against judgements she already owed me!!!! I saved legal fees, and saved $6800 in alimony no thanks to Hergert!!! I NEVER would have been in this position had Hergert done his job and protected me from assets I gave my "ex". He did not do his job and it cost me big!!!!!!! Ten years later I still am unable to collect one dime of my judgements nor recover from the damge she did to my credit!
