Outcome: HUNG JURY (not convicted) - 8 jurors voted not guilty; 4 voted guilty
Outcome: DEFERRED PROSECUTION. I negotiated with the D.A. to do a deferred prosecution – Mr. O. did not have to plea guilty, the prosecution was deferred for one year, and will be DISMISSED at the end of the year if Mr. O. stays clear of any re-arrest.
Outcome: Finding of FACTUAL INNOCENCE. To clear Mr. M.'s arrest record, I filed a Petition for Determination of Factual Innocence (P C 851.8). After evidentiary hearing, the Judge ALLOWED the Petition and ordered Mr. M.'s arrest record sealed and destroyed.
