BensBargains.net, LLC v. XPBargains.com, 2007 ILRWeb (P&F) 2453 [SD Cal, 2007]

Joshua Adam Ridless

Practice Area: Copyright Infringement

Outcome: Successfully Application to Inerent Commerce

Description: We set precedent in defining the percentage overlap necessary for a finding of copyright infringement between two compilations of pre-existing facts on competing websites. Our client, Bensbargains.Net LLC scoured the Internet for the best deals on bargains and came up with daily compilations of such deals. The Court found that where the competing website's daily compilations shared 70% or more of the bargains, infringement could be found.
