Description:Borrower suit claimed violations of TILA, RESPA and FCRA for owner occupied loan to stall foreclosure for non-payment. State court dissolved preliminary injunction and lis pisdens so lender could move forward with foreclosure. Borrower then filed two bankruptcies; after the second bankruptcy and motion for relief from stay was granted he transferred a 20% interest to a person in FL who then filed bankruptcy. We successfully filed a Motion for Relief From Automatic Stay pursuant to Title 11 USC 362(d)4 and were granted a two year relief from stay on the property.
