Outcome: Six figure settlement for Plaintiff
Description: Plaintiff was 32 y/o forklift operator, injured when forklift spun out of control in a refrigerated storage areas, and suffered a crushed left foot. Ultimately, Plaintiff had a below-knee amputation. Workers Compensation covered entire claim and all future care and retraining. I determined there was a potential claim against the refrigeration maintenance company for negligent care of its machinery, as condensation on the floor of the storage area may have contributed to the forklift spinning out of control. Despite full compensation under Worker's Comp statutes, we were able to obtain an additional settlement in the six-figure range for this man, over and above all other medical care and compensation he was entitled to receive under the Work Comp. laws.
