Description: Untied States Fifth Circuit Court of Appeals held that termination was an "ongoing violation of federal law" for purposes of the Ex Parte Young Doctrine in a Family Medical Leave Act (FMLA) case. The result of this decision is that employees of the State of Texas can enforce their FMLA leave rights. The United States District Court Judge held that no such relief was available.
