Case Conclusion Date: December 23, 2009
Practice Area: Litigation
Outcome: Anti-suit injunction affirmed by Appeals Court.
Description: The Court of Appeals affirmed the Trial Court's anti-suit injunction against Defendants, which had previously filed two suits in another county against Plaintiff, the first of which had resulted in a Mandamus by the same Court of Appeals following a county court at law's denial of a plea in abatement(see In re. Ayala). In the Defendants' second county court at law suit against Plaintiff, Defendants' obtained an ex parte temporary restraining order and temporary injunction without service on the Plaintiff, whereupon Plaintiff obtained a temporary restraining order and, later, a temporary injunction prohibiting, inter alia, the enforcement of same and the filing of any other actions by Defendants against the Plaintiff. The Court of Appeals affirmed the Trial Court's decision.
