Windsor case, involved an effort by certain asbestos companies to force FUTURE asbestos victims -- that is, people who had been exposed to asbestos but had not yet developed any asbestos-related disease -- to give up their rights to sue BEFORE those people even got sick. We opposed both the "future claimant" settlements in both the Ortiz and Amchem cases because it could never be fair to force people to make a decision about giving up their rights to sue about an injury that has not yet even developed.
