Case Conclusion Date: October 19, 2010
Practice Area: Military Law
Outcome: General Discharge
Description: A petty officer second class was facing an Administrative Separation Board for various acts of misconduct in that he was accused of falsifying several maintenance documents and forging his superior’s signature. Because the petty officer has five separate instances of Non Judicial Punishment over his career, the government was seeking an Other than Honorable Discharge. Duane Kees was able to put on evidence that not only was the petty officer a highly intelligent and experienced noncommissioned officer is his job but that he was highly sought after for his knowledge even after the charges of misconduct where brought to light. After a very emotional hearing, the Board recommended that the petty officer should be discharged with a General, Under Honorable Conditions Discharge despite the government’s plea that he be given a lesser, more disparaging discharge
