Description: After a mandatory arbitration, Mr. Jacquez was not allowed to present a defense for missing the arbitration. After the filing of an appeal, the Appellate Court determined that Mr. Jacquez's absence did not prejudice the Plaintiff's case in chief and that debarment was not a proper sanction. For these reasons the matter was reinstated and favorably disposed for the Defendant.
