I hired Attorney Gailan for felony DUI case. At times Attorney Gailan seemed focus and very knowledgeable. At other times he would forget about prior meetings and conversations we had. During some conversations he would seem confused about how I knew something before hand. I would explain that we had discussed the items in a prior conversation of ours. He would continue to seem confused and could not recall the prior conversation we had.
I paid Attorney Gailan all of the fees that he charged me for the case. I always paid him on time and I never attempted to negotiate rates.
In the beginning Attorney Gailan agreed that we had a case that would could fight and have a decent chance of winning. Out of the blue he changed his stance and said we should plea. He never explained why plea versus fight, nor did he give me the option to continue to fight. I didn't want to plea, but I didn't think it was wise to go into a fight with an Attorney that didn't want to fight so I reluctantly agreed to the plea. After the plea Attorney Gailan and I had a disagreement and he made a motion to withdraw as my attorney. At the withdrawal hearing, Attorney Gailan seemed more interested in keeping the prosecution happy than fighting for my best interests.
So what should happen to all the fees I paid him? Should I be entitled to some type of refund if he didn't finish the case?
Be careful if you decide to hire this attorney. Pay close attention that he is involved fully. Be sure that your best interests are his priority.
