United States v. Cox

E. Brian Davis

Case Conclusion Date: March 2, 2009

Practice Area: Federal Crime

Outcome: Prosecution of interstate threat

Description: This case was from years ago, when I was a federal prosecutor. Shortly after a shooting by a disgruntled ex-employee at a local business (which got massive media coverage), a man who had just had his truck repossessed called from Indiana to Kentucky and threatened bank personnel. Because of the unrelated incident, the threat was taken very seriously. It ultimately resulted in my being assigned to prosecute Mr. Cox for the threatening phone call. The case went to trial, and he was convicted. He appealed. On appeal, the Circuit Court of Appeals ruled that there was no error in his trial and the conviction stood. I include this case here as a (minor) example of my work as a prosecutor -- work I left behind in 1996.
