Description: Plaintiff, a minor child, suffered two falls on a private school's playground during the school's aftercare program. As a result, he suffered broken arms on both occasions, requiring multiple surgeries. Plaintiff proved at trial that Defendant failed to maintain its playground in a safe condition and failed to properly supervise young children in its aftercare program to ensure they were allowed to play only on age-appropriate equipment. The jury awarded $700,000. The case was later settled for a total of $800,000, accounting for attorney's fees and costs, because a $300,000 Proposal for Settlement had been submitted to Defendants prior to trial and was not accepted. Defendant's never offered over $225,000 at any point in the case until following the favorable jury verdict.
