Initially my case may have sounded like so many others, an ex-wife in the midst of a child custody proceeding. As if that was not emotionally difficult enough, my personal situation was one that the court itself did not know what to do with, let alone the previous lawyers I had retained.

The case was unusual; I was divorced from a man who wanted full custody of a child that was not his biologiclly. In the divorce judgement the Judge however made a ruling that my ex-husband was the father. Subsequent to the divorce I married the child's biological father.

Several years after the divorce Mr. Chambers undertook my representation and championed a series of successful court rulings, and an appeal and eventually a final hearing that kept my family together with my son's biological father also being designated as the legal father enabling us to remain a family without outside interference. When I disccovered my wife's ex-husband filed legal documents claiming sole custody of my biological son, I thought the ex-husbands case was without foundation, it was not!

The basis of the ex-husbands case was the exploitation of Florida's shared parental responsibility law to keep children of divorced couples involved with both parents after the divorce. Because of the "presumtion of legitimacy" his case was the reversed application of the intent of this but nevertheless legally valid.
