He filed the appeal in a satellite office of the clerk on the last day allowed, and the appeal was not formally stamped by the central office until a day later. Judge Maynard Swanson held that the existing law regarding this procedure was not constitutional, and Sanchez sued him ex officio. The apellate court agreed with Swanson and held that henceforth in florida the filing of any paper in any clerk's satellite office was to be date stamed tere and considered timely filed.
