Description: Client was stopped for not wearing a seat belt. He smelled of alcohol and his eyes were red and glassy. He admitted to drinking “five to six beers” at “Maverick’s Bar.” He was arrested and took a breath test showing a BAC of .056/.057. Since there was no probable cause to require a urinalysis, his results were not admissible. The State dropped the charges.
