    Being young, and having NO RECORD, you MAY be eligible for some sort of deferred adjudication. I have included a top NC attorney's information below.     Federal law says NO. All states must comply with federal law.
    A second lifetime DUI disqualifies you for LIFE. This includes DUI-DWI-OWI-OUI offenses that occurred in a private vehicle in any jursidiction.

    In light of you choosing to drive a vehicle that was NOT equipped with interlock, you had better hope the basis for the traffic stop was not legal. Get a very good CO attorney ASAP.     First, I assume that you were not injured, and only suffered property damage. Therefore, you are handling this without an attorney. Be sure that you have made a timely claim --- with YOUR insurer --- for uninsured motorist or underinsured motorist coverage, if you have that coverage in your own policy.

    Three things that you need to do. (1) Keep coming to court, because the defense lawyer may be hoping that you don't show up so the case gets dismissed; (2) Send a LETTER by certified mail (proving delivery) to the BOSS of the prosecutor who is handling the case (look it up on the Internet, or call the Clerk of Court to get the full name, address and re-election date of the prosecutor Explain your multiple trips to court, the very abbreviated attention you received, and your displeasure at any settlement that does not also REQUIRE restittion for your FULL damages; (3) Once the final case disposition is made, if it appears to have been made leaving you OUT IN THE COLD, then speak up! WRITE A LETTER to the Editor of the LOCAL NEWSPAPER outlining your frustration with the Prosecutor's office and his/her paid personnel who fail to communicate with victims who have repeatedly taken off time from work to come to court date after court date,

    This case may have merit. Both the at fault driver and the bike owner may be implicated. You need to see an attorney in your state who specializes in personal injury cases. Hopefully, the blood level of the at fault driver was obtained by police or hospital personnel.

    Hertz is well known for getting police invovled whenever any term of the contract is not strictly complied with. This may be turning in the car LATE, taking the car out of the area for which the rental vehicle is pemitted to be driven or taking the vehilce outside the USA (such as to Mexico).
    Your question is a very GOOD one, because utilizing the police and the criminal justice system to collect a civil debt is not proper. However, I cannot tell enough from what you have posted here to know whether or not YOU have culpability in this matter. If you were arrested and had to post bond and hire an attorney, it would behoove you to ask that lawyer for a local referral to a civil litigation specialist. Perhaps the lawsuit could be part of a CLASS ACTION. Certainly, Hertz has done this MANY times.

    This depends upon your State's laws, and any appellate cases interpreting that legal issue. I practice in GA, and our supreme court recently found in FAVOR OF making the negligent party pay for diminished value. State Farm Mut. Auto. Ins. Co. v. Mabry, 274 Ga. 498, 556 S.E.2d 114 (2001).

    Contact a local personal injury firm to ask that question, if you can't fin the answer on line.

    Your most favorable argument may be this one. You should make a public policy argument that any formula used to calculate your total loss from this accident must be adequate to place you in the same position that you were in PRIOT TO the loss. If this issue has not been litigated in AZ, see if you can get an attorney to take this matter as a CLASS ACTION, on behalf of you and other similarly situated victims of wrecks where diminished value of the repaired vehicle exists.

    If the divorce/separation is contentious, likely so. Sometimes the emotional roller coaster caused by these cases will leave the participants in a foul mood regarding cooperation about such matters. I am assuming that you are not having separate conversations with your soon to be EX-son-in-law.
    Assuming the items are sufficiently valuable, I would seek the help of a local TN practitioner, and ask him or her to draft a very diplomatic letter regarding your desire to obtain possession of these items. The lawyer will want to identify each one in as much detail as possible. Maybe you still have receipts or serial numbers. He or she will also send the letter so that proof of delivery is provable in court.

    First, you may be talking about TWO different suspensions. When you get arrested, an ADMINISTRATIVE license suspension can be set into motion, either for REFUSING the State;s breath test (following a DUI arrest) or for TAKING THE TEST and having a breath or blood alcohol level OVER the applicable legal limit (0.08 grams percent for people age 21 or older).
    Once your CRIMINAL case gets resolved at COURT, if you get convicted of DUI, then ANOTHER type of DUI suspension can be put into place. However, most states give partial or full credit for any los of license time that occurred as a result of the ADMINISTRATIVE suspension, when and if a CRIMINAL conviction suspension occurs 9in connection with the same case).
    If you had an attorney for your case, call him or her to clarify this issue. You can also get in touch with a FL DPS staff member to see exactly when you will be eligible for a full license reinstatement.
