As a general rule, the answer is "yes". You will have to reimburse your health insurance company for payments made for medical treatments relating to your personal injury if you collect money from the negligent party for those medical expenses. There are a few exceptions and an attorney can often negotiate the amounts down. You need to engage an Atlanta lawyer with experience in these type of claims.

It depends. In general, your mechanic is under an obligation to act reasonably under the circumstances to insure the safety of vehicles left in its possession. This is not an absolute duty to protect vehicles under all circumstances. Where was the vehicle left? Was it left unlocked? Have there been break-ins in the past? Was the mechanic on notice that there was a real risk that this could happen at his location? If he knew or should have known, you have a very strong argument that he...

They can try. The other driver's insurer is attempting to argue that their insured violated the terms of his policy and, therefore, the policy was not in force at the time of the accident. At a minimum, the driver of the other vehicle is still responsible for the damages. However, the quickest way to get you car repaired will be to go through your insurance company. Your insurance company can then go after the other driver and his insurer.

The prior two contributors are exactly correct. The only relevant questions are whether or not the hospital failed to maintain the appropriate standard of care in regards to the treatment of your family member and whether that failure caused or contributed to the death. You should speak to a local attorney who specializes in medical malpractice as soon as possible.

Without more information, it is difficult to answer very thoroughly. You obviously need a copy of the HOA rules. The best advice I can give is to put all future communications to the HOA in writing. Send a letter to the HOA making a reasonable request for the bylaws. Send it by certified mail.

  7. If my landlord never filled in the specific dates for my lease, leaving it blank, can they enforce a 12 month contract?

Well, it depends. It would be unusual for a lease to fail to include the term of months, the date of beginning, or the date of ending. Technically, you are correct. If the lease does not specify a lease term, it will considered a month to month lease. You should confirm if the original, signed lease included a term. If it does not, have an attorney send a letter to LL stating that you are giving 30 days notice of your intent to leave.

The two prior contributors are correct. The primary question that I see is whether you sustained anything more than nominal damages. If you suffered any injury it may be worth a call to a local attorney. Good Luck!

David gives very good advice. I would not wait for this to come to a head. I would go ahead and make an appointment with a local, criminal attorney tomorrow.
