  • Do I have to reimburse my health insurance if I receive a settlement?

I was hit by a car as a pedestrian. Am I required to reimburse my company provided insurance company expenses if I receive a settlement?

    Andrew’s Answer

As a general rule, the answer is "yes". You will have to reimburse your health insurance company for payments made for medical treatments relating to your personal injury if you collect money from the negligent party for those medical expenses. There are a few exceptions and an attorney can often negotiate the amounts down. You need to engage an Atlanta lawyer with experience in these type of claims.

My ex is filing false police reports on me I guess to be spiteful bc he gets his daughter as ordered. Should I file one

    Andrew’s Answer

Are you asking if you should file false police report to retaliate against your ex? If so, the answer is no. Filing a false report is a crime. You do not want to get involved in a tit for tat that could end with you being charged with a crime.

  • While shopping at a local nursery, my foot caught on uneven pavement, I fell and broke my foot. Should I contact a lawyer?

This was a nursery that has both paved and crushed walkways. The uneven area was paved. My medical insurance will most likely take care of most of my medical expenses. The concern I have are the lost days from work for both my husband and myself.

    Andrew’s Answer

You should contact a local attorney who can advise you on local law re premises liability. Sounds like you may have a viable claim.

    Andrew’s Answer

The prior two contributors are exactly correct. The only relevant questions are whether or not the hospital failed to maintain the appropriate standard of care in regards to the treatment of your family member and whether that failure caused or contributed to the death. You should speak to a local attorney who specializes in medical malpractice as soon as possible.

    Andrew’s Answer

Without more information, it is difficult to answer very thoroughly. You obviously need a copy of the HOA rules. The best advice I can give is to put all future communications to the HOA in writing. Send a letter to the HOA making a reasonable request for the bylaws. Send it by certified mail.

  • If my landlord never filled in the specific dates for my lease, leaving it blank, can they enforce a 12 month contract?

I moved into a rental unit and am not happy with it. While I signed a lease, the landlord never filled in the dates of said lease. Can I assume a month-to-month contract as a result?

    Andrew’s Answer

Well, it depends. It would be unusual for a lease to fail to include the term of months, the date of beginning, or the date of ending. Technically, you are correct. If the lease does not specify a lease term, it will considered a month to month lease. You should confirm if the original, signed lease included a term. If it does not, have an attorney send a letter to LL stating that you are giving 30 days notice of your intent to leave.

    Andrew’s Answer

The two prior contributors are correct. The primary question that I see is whether you sustained anything more than nominal damages. If you suffered any injury it may be worth a call to a local attorney. Good Luck!
