State v. C.Q.

Ramon Alvarado

Case Conclusion Date: December 6, 2010

Practice Area: DUI / DWI

Outcome: Not Guilty on All Counts after Jury Trial

Description: C.Q. was discovered by the police mudbogging behind an elementary school at 1 am. At trial, the officers testified that C.Q. was unstable on his feet, had a strong odor of alcohol, refused the SFT's and State Administered Breath Test, appeared to be intoxicated, and admitted to drinking 9 beers. After a careful and thorough cross-examination, Ramon was able to successfully argue to the jury that despite C.Q.'s physical manifestations, admission to drinking 9 beers, and refusal to submit to State Administered testing, that C.Q. may not have been impaired to the point he was a less safe driver. Successful argument. Not Guilty on all Counts.
