Description:My client was charged with possession of marijuana. She was the passenger in a car with a man, who was later convicted of possessing drugs, but she was unaware he had any drugs when she decided to ride with him. Police pull him over, she gets out of the car, and goes to a neighbor's house. Police find no drugs on her, but there is marijuana in the passenger seat, on the passenger floor, and outside of the passenger door. She had no criminal record and testified that it was not her marijuana. The court concluded she was not guilty of possession of marijuana because the State had not met its burden of proving she constructively possessed the marijuana.
