Description:Difficult sexual harassment case, where young receptionist in doctor's office accused employer/doctor of sexual harassment. There were no corroborating witnesses, so it was a classic "swearing match". Jury verdict was in favor of plaintiff on sexual harassment, constructive discharge, lost income, emotional distress, and punitive damages. Trial court reduced the award of attorneys' fees, and Mr. Capuder successfully appealed to the West Virginia Supreme Court, obtained a reversal of the Trial Court's reduction of attorneys' fees.
