Description: Client charged with 2nd DUI in Montgomery County. The charge was made more serious with the aggravating factor of an automobile accident. We were successful in challenging the blood test which formed the primary evidence against the client. The equipment used to obtain the blood sample was not approved by the state toxicologist and therefore was properly ruled inadmissible.
