Outcome: Military Commissions at GTMO are illegal

Description: Hamdan was prosecuted by Military Commission at GTMO, Cuba. A habeas corpus action contested the legality of the particular military commissions created at GTMO. The Supreme Court agreed and held that only Congress could lawfully create Military Commissions, and they had not done so. I authored a "Friend of the Court" Brief for Hamdan tracing the history of U.S. military commissions and demonstrating how these commissions were like no others in our history.
