In re Brady

Case Conclusion Date: 04.03.2006

Practice Area: Bankruptcy & Debt

Outcome: Bankruptcy Means Test decided in client's favor

Description: I acted as local counsel for NACBA as Amicus Curiae to assist fellow NACBA member and friend Scott Zauber with a creditor’s objection to confirmation of the debtor’s plan. We successfully argued that the Bankruptcy Means Test (introduced in the 2005 Bankruptcy Amendments) should be interpreted as fixing the disposable monthly income for over-median chapter 13 debtors rather than the actual disposable income reflected on schedules I and J of the bankruptcy petition.
