Will the case still go before a judge?
APS has accused me of a financial crime against my mother who has dementia. I did not do this. I did not commit a fraud. They said I will have to go before a judge. If my mom passes away before the court date will there still be a court hearing?
It depends whether there has been or will be a conditional exam of your mother. Therefore, it may be a good idea for you to consider hiring a very good criminal defense attorney to represent you. You asked a great question!
This answer is not legal advice and does not create an attorney-client relationship.
Take your APS case documentation to a local county criminal defense lawyer or an elder law attorney to review the case. Felony cases take a long time to go to the court and your mother’s passing away will not stop the case. It will likely go to the court. https://www.avvo.com/find-a-lawyer
