When is a good time to submit another motion for ET probation
Had a court date set to see judge for early probation termination served more than half of my probation sentence All court costs restitution supervision fees are paid in full at this time the balance is overpaid judge still denied me early termination. Did not give a reason Am I able to submit another motion what can I do
Q: When is a good time to submit another motion for ET probation? You already tried once and were denied. You state no reason why you were denied (e.g. did you have a prior VOP?) yet you were and so maybe instead of submitting your own motion you should consider having a lawyer do it for you (just a suggestion). When I file an ET Motion I speak to the PO, then the Prosecutor, try to get an Agreed Order and if I can't then, knowing as much as possible about my Judge, I structure a presentation that's catered toward the Court and gives my client the best shot at success. I don't always win (no one does) but I'm pretty sure that my involvement enhances my client's odds at leaving the Courtroom happy. I also sometimes advise my clients against filing a given motion as I generally know much more than they do about the law, the dynamics in a given Courtroom and based on my assessment I don't want to set them up for failure. But all this is about me and I have nothing to do with your case in Lakeland (where I don't practice), in the end the decision is yours to make but I reiterate that if you're gonna do it then you'd be wise to pay a local lawyer a few bucks to ensure that it's done right.
