What do I do?
I was passing through on my way home when a state trooper gave me a ticket for the radar scanning me at 90 in a 75 zone. I know for a fact I wasn’t speeding. I had just checked how fast I was going. I also had a witness in the car. There was a car next to me going way faster than I was driving. It passed both the trooper and I. He decided to pull me over.
I am currently on deferred disposition in San Antonio for another ticket that I got for going 45 in a 35 zone. It stated I could not get any moving violations. It ends in February of 2026. I admit I was speeding for that one, but the one i recently got I know for a fact I was not speeding.
I want to contest the ticket, but I can not and do not have the funds to appear in person. The clerk told me I could do a written appearance but then I would have to show up at a later date in person.
I am unsure what to do. I don’t want this to affect my other ticket if I know I didn’t do anything wrong.
Were the tickets filed in the same court? Both in San Antonio Municipal Court? If they were, you will probably need to hire an attorney to assist you. If they were filed in different courts, look carefully at your deferred disposition order to see what is required at the end to show you didn't get any new tickets, or if you just need to show no new convictions. If you need to get a driving record, the new ticket will not be on there. If you need to sign an affidavit, you will have to disclose the new ticket. If you don't have to do anything, the old court might not know about the new case. Consulting with a traffic ticket attorney will probably be the best way to sort through your options.
I think you have laid it out well... you can...
1. Pay the ticket, or
2. Dispute it through the legal process (show up and present your evidence).
I can tell you that IF the officer shows up to court and testifies to (and shows the radar/dashcam results) your speeding, the statement of you and your friend (without any real evidence) that you werent speeding will not win the day.
It seems likely that you will lose this case... and will also face the judgement for the defered ticket too.
This is an areas that Dane O'Brien provides consultation and reasonably priced legal services in. Although Avvo makes it clear to consumers that attorney answers to questions are for general purposes only and do not establish an attorney-client relationship, some attorneys prefer to add their own disclaimers to answers. You can set your custom disclaimer here and it will be automatically added to your answers. Do NOT include any direct solicitations or contact information.
Radar is pretty good now... it "locks" on to your veicle for the reading and is EXTREMELY unlikely to have clocked a different vehicle instead. Good Luck
