Neighbor keeps moving my trash cans. is he allowed to do this?

My neighbor is always moving my trash cans. we keep them by the curb and he insists on moving them all over our yard. he says that it makes the neighborhood look better, but we keep them by the road because we’re busy working. We don’t have a HOA or anything.

is he allowed to do this?

Part of living in a community is getting along with your neighbors. Doing things that annoy your neighbors, like leaving your trash cans on the street, will not win you any popularity constests, even if you have a legal right to do so. You have to pick your battles. Is the inconvenience of taking your trash cans to the curb on trash day worth being labled the obnoxious neighborhood jerk, by all of your neighbors? If you think this battle is worth the cost, both in neighborhood harmony and legal expenses, hire a real estate lawyer to take your battle to the next level.

Perhaps not. But, I agree; there is likely a local ordinance that REQUIRES you to bring the cans in after pickup. If so, you are risking a Code Violation, and your neighbor is actually helping you avoid that expense. And the fact is, EVERYONE is busy working; but somehow we all find the time to bring the cans in, so that excuse is NOT gonna cut it, sorry. I suggest you MAKE time. Hope this helps. gsg

Do you mean you leave your trash cans on the road all week long? There is possibly some local ordinance that speaks to regulating people leaving trash cans out on the road all the time. You'll have to check your local area toy can use municode for that. Once you have that info, definitely abide by it because you can bet this neighbor is going to report you at some point if there is some city or county ordinance against what you are doing. Unfortunately I cannot speak to whether they can touch your trash cans but they certainly cannot be on your property without consent as that is trespassing, so get a video of them and inform they are not allowed on your property and if it keeps happening then report it to the police. If I were in your shoes however, I would simply move my trash cans up to the house after trash day and avoid an unnecessary dispute with this neighbor that you have to live next to as things can escalate.
