Question

My husband' father passed recently, is he able to obtain a copy of the will?

My husband's father passed away recently. His wife is still alive but is not of sound mind. There are 3 siblings remaining. The oldest brother is the executor and mom's sister is the power of attorney. Mom is not of sound mind with dementia. My husband would like to have a copy of the will but is not being given access or a copy of the will. Is he legally able to at least get a copy of the will? He would just like to have for his records so that he is aware of what their wishes are? He would like to be aware of what will need to be done to make sure his mom get the proper care she needs.

First, your if the will has been filed for probate and you know what county your husband's father died in, he or you can look online for a copy of the will or simply go to the courthouse and ask for a copy. It is not free unless available online for free. If he is a beneficiary of the will, ultimately he will get a copy of the will, but you probably don't want to wait.
Additionally, it's not clear to me who Mom's sister holds a power of attorney for. If it is for your husband's father then it was revoked as a matter of law when he died. If it is for her sister, then she should be aware that whatever she does is done for the best interest of her sister, not so she can take the money. If there is an issue concernint that, then the family might think about seeking guardianship over mom.
