In Oregon who takes possession of a property when the owner dies?
My family lives on the property my husband was born on. It was owned by his parents who are both deceased now. It has 5 acres of decent farmland in Oregon. His father paid for the mobile home that his parents used to live in. Our family lives in a separate little house that my husband and his father built. His Dad died a few years ago. Right before he died a greedy money hungry HALF sister showed up and has been trying to control mom and her will and every single thing mom did. Mom was not even able to see family or speak for herself. She died under suspicious circumstances last week. I am pretty sure Kathy(the half sister) was intentionally sabotaging her health and diet. My husband has been here his whole life and has been caring for the land for years, but Kathy showed up because her own father kicked her out of his house and wrote her OUT of his will, so she became desperate. My husband and Kathy have the same Mom, but different Dads. If my husbands dad is the one who paid for and built this place does he have any more rights than Kathy who came when dad died and refused to leave? She is just after the will, assets, property, etc. We have 3 kids living and going to school her,
Upon death of owner of real and personal property the property will be transferred to beneficiaries under valid estate plan or heirs if no valid estate plan exists.
