Question

How do I know I have a case against an assisted living facility for the elderly?

If a patient is being ignored on a daily basis, and the facility is avoiding the families concerns. The patient is losing an eye due to possible negligence or neglect, has been taken to the emergency room at least a dozen time within 3 years possibly due neglect or negligence. Has also had documented injuries while in the facilities care and even has had problems staff being rough or careless. Was just contacted by a law firm about questions for other cases against the facility due to negligence and abuse. However we feel our needs would best be handled threw a separate action, any advice would be greatly appreciated.

Yes, you should speak with local/qualified counsel. CA has many qualified attorneys. This type of neglect/abuse should not occur. You can look on Avvo, ask those you trust/respect, search justice.org. Beyond that there are 2 excellent firms in CA. If you would like that information, please ask.

Lesley Clement - [email protected] Kim Valentine - [email protected] Two excellent lawyers, each with their own firm. You can't go wrong with either. I know them from a national group of nursing home lawyers. Both are known and the real deal. Please say hello for me. My only request is since I know both, please do not tell one about the other. All the best, jeff

Elder neglect or abuse is a specialized area. There are complex rules that govern these cases, and you need to find a lawyer who has the background, training, and experience to prosecute an elder neglect case. Our staff includes a lawyer who worked in the industry. In general, an assisted living facility has a responsibility to provide proper custodial care to a resident. The facility can be held liable if its employees fail to use reasonable care in providing for a resident’s basic needs. I recommend you talk to an AVVO lawyer to discuss the facts of your situation. You can obtain the contact information through the lawyer's profile. Good Luck.
