How do by proxy marriages work with divorce?
My boyfriend’s ex wife left and went back to Germany with their two children two years ago. She sent divorce paparrwork from Germany but the marriage occurred while he was in the military and they were married on base in Germany by proxy through Montana. Would the divorce be finalized with just German documentation or will they have to file for divorce through Montana to be legally divorced?
If they got married legally in accordance with the law of the state they were in (by proxy, ceremonial marriage, common-law or whatever) then the marriage is valid and will be treated the same as any other marriage.
A divorce which is obtained while one party is living in Germany and which is legal in Germany will likely be considered binding in the United States. You do not have to get divorced in the state (or country) where you got married.
