Can i apply for stay of deportation..to the second circuit ?if am appealing Or has to be in the ice office?

Im going to appeal to the second circuit since the BIA did not solve my case my lawyer said is unfair desicion on my case ... my question is that if I can apply directly to the court of the second circuit by stay of removal directly .. or it would have to be in the ice office ... my lawyer says that it is not a good idea to go with ice because it does not guarantee that I can leave with the approved application ... what other option do I have left? What are the chances to get my aplication for stay of deportation acepted
