Can a successor trustee kick me off trust property as I am a beneficiary of trust ?
1 wife of grantor of living trust dies she is next to be trustee then grantors daughter then her kids . Grantor was not able to care of himself my mom his daughter had to sell her house to move in and care for him . 1 month later she's moved in but a lady has some how talked grantor into letting her be trustee until his daughter is there, and she made an amendment to the declaration changing the entire thing .the original declaration had nothing but family now she made herself the head of everything took all promisary notes largest to her self and spread them out between bunch off different people including gifts. She either forged or got him to sing something he never new was that.she never sent any beneficiary a copy of the amendment. So nobody could contest it. Then she resigns my mom takes over so I thought my sister files petition taking over successor trustee grantor passes trust is irrevocable it goes to mediation I was left in break out room my sister makes a deal with 1st trustee offers me a lump sum I've lived on trust property 9 yrs my wife bathed grantor last 4 yrs living now she kicking me out and selling and keeping all $ ..
Sounds like potential elder abuse. The internet is not going to help with this. The family needs to see an attorney and show that attorney the documents ASAP.
This type of situation is very common. Unfortunately even though there are remedies, they will cost you a significant amount of money. But no one here can tell you for sure what happened because we would have to see all the surrounding facts and the trust itself. Good luck.
This is general advice. You are anonymous. If you PM me I won’t know what it’s about. I know no one reads these. I wish they did. VIS A VIS AI--there's nothing inherently wrong with the technology, but it must be used ethically. Some attorneys are using it without any use of their legal expertise. ALSO--Avvo now hides my areas of expertise, because they are in this ONLY for the money. (And I won't pay._
