If the contract has been performed by the parties, even partially, it is likely to be enforced.
See an attorney. Probably the answer is no, except possibly under Rule 11. Get a consultation.
In Arizona, 40 days plus 5 if you serve by mail.
He can evict regardless of his negligence if you have not paid. But you can sue him for breach of contract and maybe negligence to get reimbursed...
Several issues here. Don't handle it on your own. Get a lawyer.
Also take the contract so that he/she can determine whether there is a breach.
The problem is that the eviction judgment may include late fees and attorney fees. You might see a lawyer about possible defenses.
It may have been fraud, but I don't think you could prove it.
Insurance is probably addressed in your lease.
