Breach of Contract & Intellectual Property Infringement

My firm uses three different attorneys in Southern California for business/tax law, intellectual property law, and civil litigation. Two of the attorneys we use are rated as San Diego top attorneys (based on client and peer reviews). But, none of them could help us with breach of contract and copyrig...ht infringements in South Dakota. So we reviewed the ratings of attorneys in South Dakota and selected Boyce, Greenfield, Pashby & Welk, L.L.P. in Sioux Falls. First, this is not a small-low budget law firm like many firms. During the time we worked with them, they had 18 lawyers and a large support staff. In addition, there law office is an impressive building that is a true reflection of the firm itself. We found their rates to be comparable to the other law firms in the state. The law firm considered our case and assigned Paul Tschetter as our attorney. At first we hoped to work with one of the older attorneys in the firm because we were dealing with complex issues and we had a lot of money at stake. But we decided to rely on the firm’s recommendation and we started work with Paul. We could see from the very beginning that Paul was a highly intelligent, skilled, organized, and detailed-oriented person. Over a three-year period, we worked with Paul directly as he filed motions, argued at federal court hearing, conducted depositions, and represented us at arbitration and settlement negotiations. In fact, we traveled to South Dakota to attend every hearing, deposition, and meeting. The firm’s mission in part states: “It is our commitment to the practice of law, combined with absolute dedication to our clients. We truly care about the people we represent. Your problems become our problems. We won’t stop working until we find a solution. This firm was built on values of perseverance, integrity and hard work…the same values you’ll find in every attorney here.” If you work with Paul Tschetter, this is exactly what you get! We could tell that he really cared about us and our case. He put in a lot of long hours to help us get the job done. We also learned that Paul is well connected in the legal community across the state. This may be an advantage of being part of a large firm. As the plaintiff, part of our strategy was to overwhelm the other party with quick and well–thought out motions, responses, etc. The other party couldn’t keep up. The end result – the federal court made a judgment and large award in our favor that will benefit my business for years to come. As Paul and I traveled from one end of the state to the other, he and I got to know each other well. He is more than our attorney – he has become a close friend. Even though we are in California, we will continue to use Paul as our primary attorney to assist us with contracting and other business matters.
