Unjust Discharge

On November 2, 2012, Attorney Nathan Eisenberg represented Teamsters Local Union 627 in a discharge case where the grievant had been unjustly discharged for allegedly allowing another employee to drive a passenger vehicle that did not have the nescessary permit to transport passengers. The employer ...argued that the act of the grievant was wilful. Though cross examination of the employers lead witness, Mr. Eisenberg was able to get the witness to acknowledge that there had been other employees that had in fact drove a school bus on a expired permit, yet the witness said that action was dtermined not to be wilful and the only discipline was a written verbal warning. After the testimony of that witness, the arbitrator called for a break and the employers counsel approached the Union with an offer to return the grievant to work. Terms were negotiated and agreed to the satisfication of the Union and more importantly to the grievant, and she returned to work the next business day. Attorney Eisenberg was very well prepared, very knowleadgeble, and excellent at cross examination. I am President and Principal Officer of my Local Union and I have served in office for 33 years have had the good fortune of working with some very capable Attorneys, I would put Mr. Eisenberg right at the top of my list.
