Follow up review; very disappointing

I have a previous review where I rated Mr. Trease very highly. He has handled previous cases for me, and was in fact excellent in the last. But my wife and i's Recent experience was very disappointing. Jory was consulted on several occasions re our case after another firm we retained had said on...e thing then did another. I told Jory all about. He was too happy to dismiss that firm's interpretation and prep on our case and reassure me on several occasions of how " things would work." He painted a totally different picture... So we retained him. Jory is a bit pricey as far as ch 13 retainers go. So my wife and I discussed in depth what Jory was saying vs. what we had just experienced with the first firm (to which we lost our $400 retainer). We retained Mr. Trease, and were actually excited to go in and sign the final paperwork. Imagine our shock when the papers presented to us were no different than the first firm! Bottom line Mr. Trease is an atty... A "counselor," and his failure to advise and counsel fell very short. We were both left feeling that, like the first firm, we were told a good bunch of baloney to get our $$$, with the expectation that since we are desperate debtors we would easily sign the documents. Jory's interp of how our case may have to go could be fully correct; that's not the issue. The issue was that despite several discussions, he failed to inform us. No different than the first firm he so cavalierly dissed. To top it off, he actually offered back our money. Then when I said ok, turned it in to a game asking how much I and then my crying wife thought he deserved to keep for his "work." He did give us back the full amount... But the little game after already offering was pretty lowbrow. We may be lowly debtors who can't handle money... Chronically in my case.... But I wouldn't trade my lot in life to be Jory trease after what he just put us through. He could offer us the money to pay all our debts and we'd still stand by this rating... And refuse the $.

I am a seasoned Bankruptcy Attorney with 28 years experience. I am well aware of whom this potential client is, and I wish him and his wife the best of luck in addressing their financial circumstances. Unfortunately, this situation clearly reflects that you can not please all of the people all of the time, and you can not please some of the people any of the time. Originally when this person met with me, they indicated they owed approximately $10K in unsecured debt. After a year of coddling the potential client, when we investigated the credit report, it was determined that there was actually $115K in unsecured debt. An Attorney can not redraft the Bankruptcy Code, but must abide by the terms of the federal law based on the actual determined facts rather than those that are initially reported by a person. It is interesting to me that the person spends a significant amount of time complaining that I refunded the entire amount of the retainer to him (unlike the other firm), despite spending substantial amounts of time explaining the legal process and reasoning for the calculations in the Bankruptcy Statements and Schedules. Nonetheless, I truly hope that he and his wife find a legal professional that they feel comfortable dealing with.
