You are allowed to have simultaneous petitions. They will not ask you which one you plan to go with.

If he is still in the US, he may not adjust here. He must go home to adjust which will trigger a 10 year bar to entry.

A sponsor must meet the income or asset guidelines. I'm unaware of any way to get around that.
