This case involved rather convoluted procedural issues pertaining to a post-conviction petition where the client sought re-instatement of his direct appeal rights or, in the alternative, a new trial. ... The trial court ruled that the client could not seek both remedies, so he had to choose one. The Superior Court disagreed and held that the trial court did not follow the proper procedure. In another case, the PA Supreme Court has since disagreed with this ruling.
