They aren't giving you a termination notice because they do not want to pay unemployment insurance.

I have a release form to sign and it says I have the right to consult an attorney and the company is advising me to do so.

Under the FRCP, you should file a request for default if they have not filed an answer. More likely than not, they will then respond.

I am not a Michigan attorney, however, assuming there is no union on your job, you are an employee at will. I would need more facts to evaluate.

Assuming you are part of a union, I would grieve the issue first. At least you can contest them not compensating you.

As for the other issue of termination, you would first have to meet a requisite amount of hours to be covered under FMLA. I would need more facts.
