Do not use this Lawyer

I do not recommend David Blain, a lawyer who works at Ted B. Wacker’s firm. I was represented by David Blain for my auto accident I was involved in 3 years ago. I was rear-ended by a V-8 pick-up truck right after getting on the 91 frwy. near my house, and was pushed into the car in front of me wh...ile I was at a complete stop. Texting while driving was suspected. I sustained moderate injuries, and was recommended to contact Mr. Wacker from a mutual friend. I was then contacted by Mr. Wacker, and was told he would be coming to my house to interview me that evening. But to my surprise, it wasn’t Mr. Wacker who came that evening, but instead was David Blain. Mr. Wacker never explained he would be sending Mr. Blain to interview me, and what is role was with his firm. This caused me a lot of confusion from the beginning, because I did not know Mr. Blain’s role w/ Mr. Wacker’s firm. This was very upsetting to me, because I wanted to be represented by Mr. Wacker, who came w/ good reviews from my friend, but instead Mr. Blain represented me, who had not been a lawyer for anywhere near the length of time that Mr. Wacker’s been, or with the proven track record Mr. Wacker had. I was told by Mr. Blain that the charges if we won would be two-thirds to me, and one-third to him, but if my case went to trial the percentage (typically) would increase for him because of the time spent preparing for my case - but he then explained because I was a referral, if my case went to trial, the charges would remain unchanged. As the months dragged by, and paperwork piled up related to my case arrived in the mail, I had misc. meetings, depos, examinations and medical tests scheduled, and I was paying for a lot of bills up front from my own pocket - and only received partial re-imbursement, sometimes waiting several weeks for the partial payments to come from Mr. Wacker’s firm. When I inquired about when I would be receiving the rest of my out-of-pocket expenses, I was told by Mr. Blain, “it would be included in the settlement.” Just short of 2 years later, when my case was preparing for trial, Mr. Blain continued to urge me to settle for so little that I’m embarrassed to even mention it in this review. **PLEASE READ THE FINE PRINT** on your Agreement when (anyone) comes to your house from this firm to interview you for possible representation: You will not get all of the money you were promised - and DON’T expect it to be two-thirds - even if you were promised that. Mr. Wacker’s firm will deduct every possible charge they incurred while representing you *FROM YOUR TWO-THIRDS*: Parking fees, mileage, stamps, next-day mail / important docs / Fed-Ex, paper, office supplies, faxes, phone calls, etc.This was never explained to me, and I failed to read the fine print when Mr. Blain came to my house that evening and I signed the Agreement. And I believed my remaining out-of-pocket expenses were never re-imbursed to me. So, if you have not suffered a catastrophic injury, look elsewhere for legal representation - there’s a lot of great personal injury lawyers out there who will fight for you - and GET THE MONEY YOU DESERVE!!

Great Service!!!

I went to David Blain because I was hit from behind in an auto accident. I was injured and also wasn't sure if the lady that hit me and the car behind me was going to try to wiggle out of her negligence. Anyway, he took care of everything from a to z. Very attentive, personable and detailed. I thank... him very much for taking a very stressful situation to me and making it easier to get through :)
