Failed to return retainer after not completing trademark

Hired this lawyer to create a trademark for me. She stated she would able to consult me with business. I paid $800 for the initial payment and 2 payments of $600 was due weeks apart. I stated I wanted a trust and was told I needed to file that first before she filed the trademark. She insisted I hel...d off and told me to file a trust myself using a site I had not heard of. She advised although she stated it was outside justification and could get in trouble to lead me to file my trust in a different state than Texas. She ensured me that she could do the business filings I needed and waited til she received my money to stated she couldn’t do all things business related. I consulted her first and once I was under contract she became incompetent of her work. Not only did she take my payment but she failed to return it after she stated she couldn’t do other legal work. She sent over my contract Sunday, Monday we chatted and it came to past that she was not able to do all things business for me, she insisted I write trust on a site (stating it would only take one hour to do myself), then Thursday I asked for my funds back. She lies and said started the process. Once I corrected her lie, she stated that the intake form of the contract being drafted was the $800 fee and that it was not refundable. She requested payment through Zelle. I paid $800 and I do not have a trademark for my business. I stopped payment all together because she stated she did not know how to do certain things and could not do them. I was told that this is unethical behavior by my lawyer and my bank.

Not the best.

I paid her $2500 to do a ton of research and write a letter for me. Wasn’t the best idea. The letter had to be rewritten. She couldn’t represent me which I found out after I paid her. She also charges you for everything. Text messages, emails, scanning, and copying. Anything she can charge you. She w...ouldn’t refund me even half of what I paid her. I got nothing out of working with her. The 2 star rating is because she did give me $130 back for what she would’ve charged me for texting her about my case.

It is unfortunate that you were dissatisfied with the outcome of the services provided by our firm. We strive to inform all clients verbally and in writing of the pitfalls that may occur when pursuing a claim, prior to engagement. All terms and conditions are then outlined in the retainer agreement which states that even with the best efforts put forth for each and every case, a certain outcome is not guaranteed. In order to help resolve this situation, we waived $800 of services, with a timely notice of termination, and the full amount of fees ($2500) was subsequently returned to the client.
