I have always advocated against the the Government by defending individuals charged with crimes. I have been doing so for approximately 40 years and may go at it for another ten.. I defend immigrants against deportation/banishment from the United States It is our due process system that affords us the opportunity to enjoy a vigorous adversarial legal system that facilitates justice.
Why do I oppose the deportation of immigrants? One compelling reason is that many immigrants were brought to the United States as children and subsequently placed into deportation proceeding following criminal convictions on minor criminal offenses although they are as American as anyone born here. One worst case,albeit all too common scenario, is the immigrant is not told pre plea that he/she is virtually certain to be deported if he/she entered into a plea "bargain". . The plea is entered into for a resolution to a criminal case that carries potential prison time and the immigrant gets probation. But, this is just the beginning of deportation looming over the immigrants' life here in the US. The US Supreme Court has rightly stated that deportation "deprives one of all that makes life worth living".
I represent clients in criminal court, immigration court, appellate court and file to set aside past convictions for individuals who did not accurately receive the virtually certain immigrantion consequences of their criminal conviction pre plea. I have represented immigrants in the Circuit courts throughout the State of Oregon, before the Ninth Circuit Court of Appeals in immigration courts in Oregon and Washington and in State appeals in both Oregon and Washington. I have appeared in the Superior Courts in the State of Washington and before their appellate courts.
Before the Ninth Circuit Court of Appeals I have been able to reverse a deportation order to China which might have saved my client's life. I prevailed in front of the Board of Immigration Appeals in a important published case, In re Hadi Eslamizar 23 I&N 684 BIA (2004) which held that "aliens" convicted of "violation" offenses are not deportable.
The Ninth Circuit held that Oregon Delivery of a Controlled Substance is not an "aggravated felony" in Sandoval v Sessions 866 F3d 986(2017)., as well as in Cortes Maldonadov Barr 978 F.3d 643(2020), both of whom I had the pleasure of representing.
I have represented clients in Tacoma Washington at the NW Detention Center, who had already been ordered deported, who through my efforts on their behalf, are now citizens of the United States.
