Gary was not my client. His son was. It was his son's money, but because David was incarcerated, Gary merely facilitated getting me the retainer. Gary's son hired me Feb 2019 to take over his case from another attorney he wasn't happy with for a Chester County Parole Violation. David was incarcerated. I was able to get him out of jail. He then hired me for a PWID and DUI case in Montgomery County. I had filed Omnibus Pretrial Motions because we had a good legal issue and David wanted to defend the case fully. While that motion was pending, and in between court dates, I was able to negotiate a mitigated range offer on his case, which he accepted. Prior to the next court date unbeknownst to me David fled the Jurisdiction due to a collateral Custody issue he had with the County CYS department. David did NOT consult me before fleeing. As a result a Bench Warrant was issued for his arrest. He contacted me later via telephone, and lied to me, telling me he was outside the jurisdiction of the United States. He then got arrested in Arizona and extradited back to PA. When he came back our omnibus hearing was scheduled, and I was STILL able to keep his previous mitigated range offer open, and he plead guilty and was eligible for parole in about 3 months. While he was away in Arizona as a fugitive, he was charged with Interference with Custody of his kids, Violation of the Chester County Parole case mentioned earlier, as well as being charged with Resisting Arrest in Bucks County So he was incarcerated awaiting parole on the case I just plead him to, he hadn't made bail on the new Interference charge, he had a VOP detainer in Chester County (which is not bailable), and he had a case in Bucks county for which they had a detainer also. David retained me for the Interference with Custody case and also the Bucks county Resisting Arrest charge. He did not retain me for the Chesco VOP case right away. David wanted to fight both new charges. I met with David twice at Montco Prison. I filed an Omnibus Pretrial Motion including a Writ of Habeas Corpus in the Interference case, and I still believe the Commonwealth could not sustain that charge against him. David's primary concern was regaining custody of his kids, and the only way he could reasonably do that was to beat this charge. He had a complete defense. He had legal custody of his kids when he fled the jurisdiction of PA with them, so it was a legal impossibility for him to have been found guilty of this charge. I have been practicing law for 20 years and have had over 80 major jury trials. He had a winner. His problem was he could not get out of jail, and this became his driving concern. He became impatient. Just after I filed the Pretrial motion, the Courts were effectively closed due to Covid 19 pandemic (as of March 17). They were not opened again and video hearings did not begin in most counties until around June 30th. I wrote to David at Montco explaining the situation twice. David's case was last scheduled for status on April 11, 2020, but was not held due to Covid. In the intervening period, David made numerous statements that were communicated to me which made it ethically impossible for me to continue as his attorney. As a result I had to file motions to withdraw as counsel in early June 2020 and they were granted. I was out of the cases before the courts resumed business. David ended up pleading guilty in the Interference case in Sept. which I still believe was a mistake, albeit it was to a much lesser charge. My hard work and the Omnibus motion I filed likely led to this result. David remains incarcerated today, and his Bucks County case is listed for trial in December 2020. Everything that I told David and Gary happened exactly as I said it would. It is a case of sour grapes. He is STILL incarcerated, just like I told him he would be, and his Bucks case is STILL pending. You know what they say...you can lead them to water..
