Washington has established some of the nation's strongest "sanctuary" protections. However, recent data from the Deportation Data Project shows a significant surge in ICE arrests within the state. This review analyzes the friction between the state’s Keep Washington Working Act and federal enforcemen...t tactics. Despite legislative mandates, investigations have revealed instances where federal agents bypassed state protections: In 2025, it was discovered that ICE agents continued to access Department of Licensing (DOL) data to track undocumented residents, leading the state to slash access to these databases. Legal scholars have documented "justice compromised" scenarios where ICE agents monitored state courthouses to apprehend individuals attending hearings for minor offenses. The Northwest Detention Center in Tacoma remains the focal point of enforcement in the region. Recent litigation, such as Nwauzor v. GEO (2025), has seen the state successfully demand that private detention operators pay detainees the state minimum wage. The effectiveness of state officials in Washington is currently defined by their ability to limit rather than help deportation efforts. The ongoing legal battle centers on whether the state can truly insulate its residents from federal reach or if administrative "leaks" will continue to facilitate removals.
